ACPA Debuts Concrete Pavement Podcasts

ACPA is pleased to announce the launch of their first concrete pavement industry podcast—digital audio files that can be played on computers and other digital devices, directly or through dedicated music and podcast apps. Working with Tom Olson, Olson Construction Law (ACPA Member), monthly podcasts will be introduced on relevant construction law topics, and topics of interest to ACPA members, chapters, staff, and those interested in the concrete pavement industry.

Bill Davenport, VP-Communications-ACPA said, “We’re excited about the addition of podcasts to our communications resources. Podcasts are ideal for interviews and reports on topics that can help our contractors and other members, and the format allows people to listen on demand when it’s most convenient.” The debut podcast covers an important topic in construction law, the implied warranty of design, which Tom explains clearly and concisely. He explained that although this is one of the most important parts of a contract, it is not actually written into the contract language. He describes what contractors should know about this topic and how to manage the associated issues in public works construction projects. Infrastructure Working Group Meets with the Transportation & Infrastructure (T&I) Committee StaffersACPA and other member associations comprising the Infrastructure Working Group—coalition of national organizations led by The National Association of Manufacturers and The Associated General Contractors of America—had a virtual conference the week of March 8, 2021. The conference was to assess the current status of the highway reauthorization, and to discuss ways to collaborate on the goal of informing and persuading elected officials to pass a robust highway bill … and to do so soon.

It appears that H.R. 2 will be used as starting point, and staff is considering input from stakeholders and Members of Congress. The committee (both majority and minority) is optimistic about bipartisan effort, something that will be particularly important as the Administration appears to want Congress to take the lead. Peter DeFazio, Chairman, wants to create a bill by the end of spring. One consideration in favor of bipartisan action is the good working relationships between majority and minority leaders in the House T&I and Senate EPW committees. Funding remains the major issue, but it appears the Chairman is open to a plethora of funding streams. Members appear to be committed to finding a funding solution, adding that fixing the HTF is of paramount importance.

Meeting Focuses on Interest in OverlaysThe Federal Highway Administration (FHWA) held a Targeted Overlay Pavement Solutions (TOPS) meeting on March 16, 2021 to discuss state highway agencies’ current interest in the various concrete overlay technologies recognized by the FHWA’s Every Day Counts program.

Currently, expressed an interest in concrete overlays through the EDC6 TOPS program: California, Washington, D.C., Florida, Hawaii, Louisiana, Michigan, Montana, North Carolina, Nevada, New York, Oklahoma, Ohio, Pennsylvania, Puerto Rico, and the Virgin Islands

ACPA is asking affiliated chapters to urge state agency partners that have not yet committed to participate in this program to do so. The Every Day Counts-6 initiative is a state-based model used to identify and deploy under-utilized innovations: saving time, money and resources that can be used to deliver more projects.
